"You have got to be kidding me"Lloyd said"No, we would have no control if they took
over."I told him we will not sell if there is no guarantee it will remain a park, as you
could trade if for something else and I'd end up with who know what being built next
door to me.
Lloyd said, "You know Russ Royer and I were just discussing that a few minuets
ago and we cannot recall a time that the City ever traded some park property for
other property."
I asked"Lloyd how can you think I'm so stupid?Right now you're trading an acre south
of Marvell for another acre a builder owns. He asked who told me about that? I said one
of the guys from Parks Dept. I also said, do you know the Meltebekes? They traded the
radio station, Autzen stadium area for a park so they could build houses on it. Lloyds
response was "Oh, yeah the big one." Then he told me"I'm going to have a hard time
selling this to parks. As if I would reconsider. What????Do you mean Parks won't want
it designated a park forever? Or is this a way to buy it for a"park" and then do what ever
you want with it? Silence... No answer from Lloyd.
Then I told him loudly, the property is not for sale, the only reason I'm talking to you is
because of the threat of condemnation. Because of how the city has treated us and how
you're lying to me now it makes my stomach crawls,' 111!I I
3/6/02
Received `Final offer' from Lloyd Williams.
*The city agrees not to improve Terra Linda until such a time as sellers decide to sell,
subdivide, or further partition remaining property.
*at some future date, should the sellers substantiate a need for a fence between the
remainder property and the proposed acquisition are. The city agrees to install such a
fence at city expense. The City agrees not to remove sellers' east fence until such time as
the park is actually developed.
*City agrees to maintain the property by keeping the grass and weeds mowed and trash
picked up.
*The City agreed to purchase 524 nursery trees at$15.00 per tree for a total of$7860.00.
The seller will retain 198 black walnut trees.
*The City shall assume any tax responsibility on the acquisition parcel that may be
triggered by the City's acquisition of the approximately 4.4 acres that is presently in farm
tax deferral program. Further it is understood that the proposed sale and partition shall
not be conditioned on the remainder of the property being annexed to the city.
When we went to close at Cascade Title late in April we read through the closing papers
and found the city had `Forgot" all the aforementioned items and replaced them with a
page that read.
By signing this, all previous agreements with the city about this property either written or
verbal are hereby null and void and this document takes precedent.
When we asked the closing officer where all the other details were ?!?? She asked if we
had it in writing, yes we do, so she advised us to call our attorney.
5/4/02
We went back in to sign papers with the additional information. We sold the 4.4 acres to
the City and it had been down hill from there!!
That spring the mower showed up to do the field. He introduced himself and said he'd
come by 3 times a year. When he finished I got out my mower and did the edges and
4
