11/7/01
Received letter with an offer of$293,100.00 for 4.4 acres. We were not happy about it,
but with the threat of condemnation hanging over us, I decided to call Russ Royer a few
days later. He returned my call on 11/15/01
11/15/01
I told Russ Royer again we do not want to annex I told him the future road will have to
swoop south to line up with the other end. I asked again about compensation for loss of
Value and he offered none. I told him I do not want my zoning changed. He didn't think
it would. He asked if we just don't want to sell the property at all. "NO! NO! Is THAT
plain_enough??For sure if it caused us to get sucked into the city and pay more taxes, we
don't want to..."He'll get back to me on the road and annexing question.
12/3/01
Russ Royer called and said we won't have to annex. They will not pay for loss of value
or property income. At this late date he informs me the city will mow a couple times a
year. What??? The weeds will take over.
12/7/01
I called Tim Rahy at Park Maintenance. He thought they would probably mow it 3-4
times a year. I asked who does the edges and between the trees? He didn't really know,
so I called Andrea Reiner.
12/10/01
Andrea returned my call and I asked her how it would play out if we sold our place to the
city. She told me they take care of the mowing and weeds. She wanted to meet us and see
if they could use some of the nursery stock in other places.
1/9/02
Russ Royer called and said he had a concern with our desire to have it a park perpetually.
He told me they could only do that if people are donating their property to the city. I told
him you are trying to sell us on the idea of a park next to us but you won't guarantee it
will always be a park. You could choose to use it for what ever you want if it is not
designated. That is out of the question for us! He'll look into it and see if there is some
way to work it out.
1/22/02
Met with John Weber(parks). He asked us to make a list of the nursery stock on the
future park land so they could buy them from us. They definitely don't want the black
walnut trees so he told me we could leave those in and take them out whenever we want.
I told him that it would be nice since my wife wants to make rustic log furniture with the
trees.
3/1/02
Lloyd Williams called. He apologized for not getting back to me sooner. "Everything is
settled except for making it a park forever" (in perpetuity). "I'm sorry there is no way for
the city to do that." I countered, "just put it in the escrow instructions." Lloyd said
"We would run into all kinds of problems with that. Forever is a long time and there is no
way we can guarantee that. If Russia invades and takes over our government we would
have no control over maintaining this as a park forever." I couldn't believe it!! I said,
3
