said"Don't send me any such letter, if you die, someone else will find that in my file and
bingo they would condemn our property. He said"Ok, I'll send you a generic version.
Just the way he acted I had an uneasy feeling about that condemnation letter. For the first
time in our life, we hired an attorney and did some other research. Property just sold on
Santa Clara Ave for$150,000 an acre. Our church purchased property for over$100,000
an acre on River Road. Mike Gerot just sold the City an acre for a park for$296,000(in
lots)off River Road.
Lloyd Williams called to ask if we have any questions on the offer. I returned his call and
told him of the other sales I'd found and he dismissed them as not comparable. He's sorry
he wishes he could pay me more but that's all they can pay. He can only pay what he
appraised it for.
May 10th, 2001, my attorney called and said"I talked with the boys from the City and
they want your property. If you don't sell it to them, they are going to take it,through
eminent domain. One way or another, they are going to have your property so it's best to
work with them.
The next few months I worked with my attorney trying to deal with the city.
8/24/01
The attorney called to say the city offered to let us keep the property north of the future
Terra Linda as a compensation for the loss of value to the remainder. I asked, "They pay
for it and then allow me to keep it?" He said, "No they allow you just to keep it. I said
"Great they allow me to keep my own land in trade for the loss of value to the remainder.
What a deal!"
8/29/01
Received a copy of a letter to the city from the attorney asking them to keep him
informed as they start"taking" the property.
9/1/01
Talked with my attorney and he has not heard anything from the city. So I decided that I
would call them.
9/1/01 3:18 PM
Called Russ Royer(senior real property officer)to discuss the property. The conversation
was over an hour long. He told me he could not see where the attorney came up with such
a high"loss of value." I told him it was closer than the cities offer of'No loss of value to
the remainder."
At one point he said how about we give you the 4 lots to the north of the future Terra
Linda as compensation for loss of value and you pay only for 1/2 of the cost of the street. I
told him if any plans call for improving Terra Linda from the east then we'd just as soon
you go look for another piece of property because We Don't Want a Road Back there!
I told him to make us an offer with all the items we discussed(no road, fair price,
compensation for loss of value, no annexing etc.) and send it so us. Mean while winter is
coming on and we have things to do in the field. He offered to let us work out there even
after they buy it.
2
