6.515 <br />Eugene Code <br />6.519 <br />(a) Poison oak. <br />(b) Poison ivy. <br />(c) Blackberry bushes that extend into a public thoroughfare <br />or across a property line. <br />(d) Vegetation that is: <br />1. A health hazard, <br />2. A fire hazard because it is near other combustibles, <br />or <br />3. A traffic hazard because it impairs the view of <br />a public thoroughfare or otherwise makes use of the <br />thoroughfare hazardous. <br />(e) Trees in violation of section 7.645. <br />(3) As used in sections 6.515 to 6.527, the term "obnoxious <br />vegetation" includes, on u dew veloped property, between June 15 and <br />Se t� mber_30 of a year: 110000M <br />(a) Weeds more than 10 inches high. <br />(b) Grass more than 10 inches high and not within the <br />exception stated in subsection (1) of this section. <br />(4) As used in sections 6.515 to 6.527, the term "obnoxious <br />vegetation" includes, on � �d property at me: <br />(a) Weeds or an 10 inches hi <br />(b) Grass more than 10 inches high and not within the <br />exception stated in subsection (1) of this section. <br />(5) Except as section 6.517 provides to the contrary, no owner <br />or person in charge of property may allow obnoxious vegetation to be on the <br />property or in the right -of -way of a public thoroughfare abutting on the <br />property. Obnoxious vegetation so located is a public nuisance. <br />(6) In accordance with sections 6.519 to 6.525: <br />(a) The city may abate the nuisance and <br />(b) The costs that the city incurs in the abatement may be <br />charged against the owner or person in charge or against the <br />property itself. <br />(Section 6.515 amended by Ordinance No. 17073, enacted May 20, 1974, and <br />Ordinance No. 18199, enacted May 31, 1978.) <br />6.517 Obnoxious Vegetation - Waiver Where strict compliance with <br />the requirements of section 6.515 would be impracticable as they <br />apply to a type or height of weeds or grass, to height of tree branches, or <br />to a part of a parcel of property, the director of public works may waive <br />those requirements as they so apply. <br />(Section 6.517 amended by Ordinance No. 17073, enacted May 20, 1974, and <br />Ordinance No. 18199, enacted May 31, 1978.) <br />6.519 Obnoxious Vegetation - Notice Between May 1 and June 15 of <br />each year the finance officer shall cause to be published three <br />times in a newspaper of general circulation in the city a copy of section <br />6.515, as notice to all owners and persons in charge of property of their <br />duty to keep their property free of obnoxious vegetation. The notice shall <br />state that the city is willing to abate such a nuisance on any particular <br />parcel of property at the request of the owner or person in charge of the <br />property, for a fee sufficient to cover the city's costs of such abatement. <br />The notice shall also state that, even in the absence of such requests, the <br />city intends to abate all such nuisances 10 or more days after the final <br />1 <br />6 -26 12/27/83 <br />
