6.519 Eugene Code 6.525 <br />publication of the notice, and to charge the cost of doing so on any <br />particular parcel of property to the owner thereof, the person in charge <br />thereof, or the property itself. <br />(Section 6.519 amended by Ordinance No. 17073, enacted May 20, 1974.) <br />6.521 Obnoxious Vegetation - Private Abatement <br />(1) Within 10 days after the third publication of the notice for <br />which section 6.519 provides, or as soon thereafter as a nuisance as <br />defined in section 6.515 occurs, the owner or person in charge of the <br />property where such a nuisance occurs shall abate the nuisance, except as <br />subsection (2) of this section provides to the contrary. <br />(2) The owner or person in charge of property who is apprehensive <br />that vegetation on the property is likely to be allegedly in violation of <br />section 6.515, or who denies that a nuisance as defined in that section <br />exists on the property, may file with the finance officer a written protest <br />denying that such a nuisance exists on the property. The city manager or <br />his designate shall then determine whether the nuisance does so exist. <br />That determination shall be final. If it is affirmative, the owner or <br />person in charge shall cause the nuisance to be abated within 10 days after <br />the determination. <br />(Section 6.521 amended by Ordinance No. 17073, enacted May 20, 1974.) <br />6.523 Obnoxious Vegetation - Abatement by City <br />(1) If, within the 10 days allowed by section 6.521 for abating <br />a nuisance as defined in section 6.515, the nuisance has not been privately <br />abated, the city manager or his designate shall cause it to be abated. <br />(2) The person authorized to cause, or retained to do, the <br />abating may enter upon the property at reasonable times for purposes of <br />investigating and abating the nuisance. <br />(Section 6.523 amended by Ordinance No. 17073, enacted May 20, 1974) <br />6.525 Obnoxious Vegetation - Collection of Costs <br />(1) The finance officer shall cause the owner or person in <br />charge of the property, or both, to be billed for the abatement. The bill <br />shall state that it may be protested in writing within 10 days after its <br />date, to the finance officer. If it is so protested, the city manager or <br />his designate shall determine the proper amount of the bill and notify the <br />owner or person in charge, of the amount so determined. That determination <br />shall be final. <br />(2) Within 10 days after receiving the bill, if it is not so <br />protested, or within 10 days after the determination, if the bill is so <br />protested, the owner or person in charge shall pay the bill. <br />(3) If the bill is not paid within 30 days after expiration of <br />the 10 days, the finance officer may cause legal action to be brought in <br />court for the amount of the bill, as originally stated, in case of no <br />protest of that amount, or as determined by the city manager or his <br />designate, in case of protest of its originally stated amount. <br />(4) If the bill is not paid within the 30 days, the finance <br />officer may also proceed under section 6.100 to cause a lien to be <br />established against the property for the amount of the bill. <br />(Section 6.525 added by Ordinance No. 17073, enacted May 20, 1974.) <br />6 -27 12/27/83 <br />
