(2) The city manager, or the manager's designee, shall approve the type, location, <br />spacing, and number of trees, shrubs or plants prior to issuance of the permit. = , <br />(3) A permit shall not be required hereunder for the planting of any flowering or fruit <br />bearing plant, other than a tree, that does not violate the requirements of subsections 6.010(i) and 0) of this <br />code. ' E <br />9.538 General Yard Regulations <br />(6) Vision clearance required <br />(a) Lots in all districts shall have vision clearance areas on all street corners and at each point <br />where bicycle and pedestrian travel intersect with vehicular traffic or with each other. Each leg of the vision <br />clearance area shall be a minimum of 15 feet in length. (See brochure) <br />(b) Vision clearance areas shall be kept free of all visual obstructions from two and one -half feet <br />to nine feet above the curb line. Where curbs are absent, the crown of adjacent streets shall be used as the point <br />of reference. <br />(c) Vision clearance requirements may be waived by the city manager or designee, if the city <br />manager or designee fmds: <br />1. Traffic can safely approach and enter the intersection or street given existing traffic control <br />devices or other physical conditions of the area; or <br />2. Topographic conditions are so extreme or building structures exist such that it is not practical <br />to provide required vision clearance. <br />9.544 Yard Exceptions and Permitted Intrusions Into Required Yards <br />(c) Fences and walls <br />1. In any residential district, a fence or wall, not to exceed six feet in height may be located or <br />maintained within the required interior yards except where the requirements of vision clearance apply. Fences <br />or walls may be placed in front yards provided they do not exceed 2 -1/2 feet in height. Fences or walls between <br />2 -1/2 and six feet in height shall be permitted in residential district front yards provided: <br />a. Plans and specifications are approved by the building official and a building permit has been <br />issued. <br />b. There will be adequate vision clearance for vehicles and pedestrians passing on public <br />rights -of -way as well as those leaving development sites and adjacent properties. <br />
