(j) Vision obstructions Any vegetation, structure, mounding of earth or <br />other physical obstruction: <br />1. Which encroaches upon the vision clearance area defined in <br />subsection 9.538(6) of this code; or <br />2. Which is higher than 18 inches above the crown of the adjacent <br />roadway in that portion of the right of way between the property line and the <br />curb line within 35 feet from the intersection of curb lines, if extended, at any <br />street intersection or within 15 feet from the intersection of the curb line with an <br />alley. If no curb exists, no such use of the right of way shall be made within 25 <br />feet of the corner of the private property closest to the street intersection. <br />(k) Sidewalk accumulations An accumulation of leaves, snow, ice, rubbish <br />and other litter or any obstruction upon a sidewalk. <br />6.815 Obnoxious Vegetation - Definitions. Prohibitions. Abatement <br />(1) As used in sections 6.815 to 6.845, the term 'obnoxious vegetation" includes: <br />(a) Weeds more than 10 inches high. <br />(b) Except agricultural crops that are not a fire hazard or a vision <br />obstruction as defined in section 6.0 100), grass more than 10 inches high. <br />(c) Poison oak or poison ivy. <br />(d) Blackberry vines or vegetation that:. <br />1. Is a fire hazard because it is near other combustibles; <br />2. Extends into a public way or a pathway frequented by children; <br />3. Extends across a property line; or <br />4. Is used for habitation by trespassers. <br />(e) Vegetation-which is a vision obstruction as defined in section 6.0100). <br />(2) Except as section 6.820 provides to the contrary, between June 15 and <br />September 30 of each year no owner or person in charge of undeveloped property may allow obnoxious <br />vegetation to be on the property or in the public way abutting the property. Obnoxious vegetation so <br />located is a public nuisance. <br />(3) In accordance with sections 6.820 to 6.845: <br />(a) The city may abate the nuisance and <br />(b) The costs that the city incurs in the abatement plus a penalty may be <br />charged against the owner or person in charge or against the property itself. <br />6.820 Obnoxious Vegetation - Waiver Where strict compliance with the <br />requirements of section 6.815 would be impracticable as they apply to a type of <br />obnoxious vegetation, to the height of weeds or grass, to height of tree branches, or to a part of a parcel <br />of property, the director of public works may waive those requirements as they so apply. <br />Trees and Foliage in Right -Of -Way <br />7.635 Foliage - Permit to Plant <br />(1) No person shall plant, or allow to be planted in a public right -of -way, pedestrian <br />right -of -way, or pedestrian easement, a tree, shrub, or plant without obtaining a permit at least ten days prior <br />thereto. <br />
