ADMINISTRATIVE ORDER NO. 58 -13 -07-X9 <br /> Public Works Department <br /> City of Eugene, Oregon <br /> ADOPTION OF RULES FOR GOLDEN GARDENS PARK IN -WATER <br /> DOG TRAINING PERMITS. <br /> The Executive Director of the Public Works Department of the City of Eugene finds <br /> that: <br /> A. Section 2.019 of the Eugene Code, 1971 authorizes the City Manager to adopt <br /> rules for administration of provisions of the Eugene Code. Pursuant to the authority of <br /> Administrative Order No. 21 -03 -12 issued by the City Manager, the Executive Director of the <br /> Public Works Department is authorized to regulate City parks, protect park visitors and the park <br /> environment, and adopt rules regarding the use of parks. <br /> B. On June 17, 2013, I issued Administrative Order No. 58 -13 -07 proposing to adopt <br /> Rules for Golden Gardens Park in -water dog training permits in order to establish a formal <br /> permitting process and regulations for the in -water dog training activities taking place at Golden <br /> Gardens Park. <br /> C. Notice of the proposed adoption was given by making copies of the Notice that <br /> was attached as Exhibit A to Administrative Order No. 58 -13 -07 available to all current <br /> licensees, to any person who had requested such notice, and by publication of the Notice in the <br /> Register Guard Newspaper on June 24, 25, 26, 27 and 28, 2013. The Notice provided that <br /> written comments or objections to the proposed Rule be submitted within 15 days of the first <br /> date of publication of the Notice. One e -mail comment and five telephone comments were <br /> received in response to the Notice, to which I make the following findings: <br /> Comments Received by Telephone: All of the five telephone calls received were <br /> questions about how the proposed rule would be applied to specific fact scenarios, and <br /> requests for information, with one request for an application. <br /> Finding: Staff provided information to the callers in response to their requests. No <br /> changes are being made to the Rule as a result of these questions. <br /> Comment Received by E -Mail: One e -mail comment was received voicing the opinion <br /> that the requirement for proof of registration and rabies vaccination in order to receive a <br /> permit is absurd. <br /> Finding: In order to provide for the safety of all park users and their dogs, the <br /> requirement of licensing and rabies vaccination is needed. This same requirement also <br /> applies to all other authorized off -leash dog uses in City of Eugene parks. No changes <br /> are being made to the Rule as a result of this comment. <br /> Administrative Order - Page 1 of 4 <br />
