• <br /> F. East Alton Baker Park is subject to Section 6(f)(3) provisions of the <br /> federal Land and Water Conservation Fund Act. <br /> G. East -A1ton Is dedicated as park.propertY•and therefore, the <br /> Sections can be transferred to EUGENE and SPRINGFIELD and by SPRINGFIELD to <br /> DISTRICT without compensation pursuant to ORS 275.33 <br /> H. It would be in the best interest of all parties for COUNTY to convey <br /> ownership of the Central Section of East Alton Baker Park to EUGENE and for <br /> COUNTY to convey ownership of the Eastgate Section of East Alton Baker Park to <br /> SPRINGFIELD and SPRINGFIELD to convey ownership of the Eastgate Section of Alton <br /> Baker Park to the DISTRICT. <br /> I. COUNTY, EUGENE, SPRINGFIELD, and DISTRICT acknowledge that the voters <br /> approved Ballot Measure 20 -01 (Exhibit 'B') which has an effective date of March <br /> 3, 1993. The Measure's purpose was four -fold: <br /> first to preclude the use of <br /> East Alton Baker Park as a public or private golf course; second, to convene a <br /> Citizens Planning Committee to develop a plan for East Alton Baker Park which <br /> would contain an appropriate mix of passive recreational uses and be consistent <br /> with the Alton Baker Park Master. Plan; third, to restrict the use of any fees <br /> charged for use of the park to activities consistent with the Alton Baker Park <br /> Master Plan; and four, to insure that if the property was transferred, that the <br /> property would be used in a manner consistent with the goals of the Measure and <br /> the Alton Baker Park Master ?Ian. By entering into this Intergovernmental <br /> Agreement, the parties intend to act consistent with these goals. <br /> J. In Measure 20 -01, the voters adopted a finding that East Alton Baker <br /> Park, which contains open public land in, a relatively natural state and is <br /> easily accessible by County residents, should continue to be a place where <br /> diverse passive recreational activities can occur and no single use dominates <br /> others. <br /> AGREEMENTS <br /> IN CONSIDERATION of the mutual agreement of the parties hereto, the parties <br /> hereby agree as follows: <br /> 1. CENTRAL SECTION OF EAST ALTON BAKER PARK. COUNTY agrees to convey <br /> ownership of the Central Section of East Alton Baker Park to EUGENE as <br /> soon as a conveyance instrument is ready for signing. EUGENE agrees to <br /> assume ownership of this property upon recording of the deed. Except <br /> as provided below in Sections 19 and 19 of this Agreement, this pro- <br /> perty is conveyed as is and COUNTY has no obligation nor liabilities <br /> concerning its condition arising after the time the transfer document <br /> is filed. <br /> which <br /> arose, orassumes <br /> willnarise, prior to the date any claims, known <br /> datethat thetrans <br /> unknown, <br /> fer documents is filed with Lane County Records. <br /> 2.
