, u .. <br /> INTERGOVERNMENTAL.AGREEMENT - <br /> THIS AGREEMENT is entered into by and between LANE COUNTY, a political sub- <br /> division of the State of Oregon, hereinafter referred to as COUNTY, and the CITY <br /> OF EUGENE, a municipal corporation, hereinafter referred to as EUGENE, and the <br /> CITY OF SPRINGFIELD, a municipal corporation, hereinafter referred to as SPRING- <br /> FIELD, and the WILLAMALANE PARK AND RECREATION DISTRICT, a district duly formed <br /> under the laws of the State of Oregon, hereinafter referred to as DISTRICT. <br /> RECITALS <br /> A. ORS 190.010 and the Lane County Home Rule Charter provide that units of <br /> local government may enter into agreements for the performance of any or all <br /> functions and activities that a party to the agreements, its officers or agents, <br /> have authority to perform. . <br /> B. COUNTY, EUGENE, SPRINGFIELD, and DISTRICT recognize that public service <br /> is more efficiently and less expensively delivered when the metropolitan juris- <br /> dictions provide the services and facilities in the urban areas and the COUNTY <br /> provides them in the rural areas. The parties have therefore cooperated over <br /> the past decade to transfer facilities amongst each other to implement this <br /> urban transition program. . <br /> C. DISTRICT is a Park and Recreation Special District as defined in ORS <br /> 198.010 et seq. and ORS 266.010 et seq. organized to provide park and recreation <br /> facilities and programs in the Springfield Metropolitan Area. <br /> D. COUNTY, EUGENE, SPRINGcI_ELD, and DISTRICT have determined that EUGENE <br /> should be responsible for public park and recreation services in the Eugene <br /> Metropolitan area, that DISTRICT should be responsible for public park and <br /> recreation services in the Springfield Metropolitan area, and that the COUNTY <br /> should be responsible for public park and recreation services in the rural <br /> areas. _ <br /> E . COUNTY is the owner of East Alton Baker Park, which is that area of <br /> Land within Alton Baker Park that is owned by Lane County, comprising the <br /> approximately 237 acres east of the City of Eugene Equipment yard and Bike Path <br /> to the eastern border of Alton Baker Park. The Central Section of East Alton <br /> Baker Park is located within the jurisdiction of EUGENE, and the Eastgate Sec- <br /> tion of East Alton Baker Park is located within the jurisdiction of DISTRICT. <br /> Both sections are within the Eugene /Springfield Metropolitan Area and are iden- <br /> tified in Exhibit 'A' attached hereto. Given the determination that the DIS- <br /> TRICT and EUGENE are the appropriate providers of park and recreation services <br /> in the Eugene /Springfield Metropolitan Area, COUNTY no longer has a public need <br /> for these properties. <br /> 2.19.93 1 <br /> 15 <br />
