Agency /State <br /> Agreement No. 26219 <br /> Agency shall perform all such work in accordance with the goals, objectives <br /> and guidelines outlined in their Restoration and Management plan for the <br /> Landfill Cover and their East Alton Baker Park Plan. <br /> No modifications to standards and practices referenced in this agreement will <br /> be allow without prior coordination between Agency and State project <br /> managers and final approval by State. <br /> b. Agency services under this Agreement shall be performed on WNA areas as <br /> outlined in this Agreement. <br /> c. Agency shall promptly communicate with the State's Contract Administrator <br /> or designee any change Agency wishes to make to any services outlined in <br /> this Agreement. <br /> d. STATE ACCESS. Agency hereby grants State the authority to occasionally <br /> enter onto Agency's portion of the WNA as required for the purpose of the <br /> State accessing the adjacent 1 -5 State Highway facilities located within State <br /> right of way for maintenance. Significant or ongoing access requirements by <br /> State, that may impact use of Agency's portions of WNA, Canoe Canal, <br /> multiple -use paths and soft -trail by the public, shall be negotiated between <br /> State and Agency prior to need. <br /> Agency shall not utilize State right of way area, including the western slope <br /> area of 1 -5 for the purpose of creating new WNA facilities, enhancements <br /> and /or recreational facilities and shall not encourage public use of State right <br /> of way outside the existing WNA boundaries. <br /> 2. Operations and Maintenance. Agency shall be responsible for all operations <br /> and routine maintenance and repair work required on Agency's portions of the <br /> WNA. Canoe Canal structure, multiple -use paths, soft - trail, slope paving <br /> surfaces, landscape area surrounding paths and soft -trail within State 1 -5 right -of- <br /> way and western 1 -5 slope area, as described below. <br /> Maintenance and repair activities include, but not limited to: minor structure <br /> rRepairs, landscaping, sweeping, mowing, and removal and control of brush, <br /> hazardous, invasive and toxic weeds and debris, litter and graffiti removal and <br /> control. <br /> routines or upon written notice of hazardous condition as deemed by State. <br /> a. Canoe Canal Area of Responsibility. Agency shall maintain and repair <br /> WNA area, Canoe Canal ctructurcretaining wall surfaces, multiple -use paths, <br /> P -10 Pre's Running (Soft) Trail and P -11 Canoe Canal Trail, path shoulders <br /> Key 14259 Page 5 of 17 <br />
