Agency /State <br /> Agreement No. 26219 <br /> and railing, landscaping and slope paving surfaces that lie between northern <br /> Canoe Canal retaining wall and southern abutment of State's 1 -5 Canoe <br /> Canal Bridge and between State's 1 -5 right of way centerline and western <br /> boundary, as outlined in Attachment 1. <br /> b. Walnut Road Underpass Area of Responsibility. Agency shall maintain <br /> and repair areas within 1 -5 State right -of way, which includes WNA area, P -14 <br /> Ruth Bascom Riverbank multiple -use path, path shoulders, landscaping, <br /> slope paving surface and river bank areas that lie between the southern edge <br /> of 1 -5 WRB security fencing to the north bank of Willamette River, from <br /> State's 1 -5 right of way centerline to State's western right of way boundary, as <br /> outlined in Attachment 2. <br /> c. 1 -5 Western Slope Area of Responsibility. Agency shall be permitted to <br /> maintain area within State's 1 -5 western slope area from western boundary of <br /> State's 1 -5 right of way up to State's right a way fence and retaining wall, <br /> between State's 1 -5 WRB and Canoe Canal Bridge, as outlined in <br /> Attachments 1 and 2. <br /> Hazardous vegetation and debris and graffiti from retaining wall surface will <br /> may be removed during standard maintenance routines, upon written <br /> •e . • e •. [EPJ3JAgency represents that at the time this Agreement is written sufficient funds <br /> are currently available and authorized for Agency to fulfill its obligations under <br /> this Agreement. If at any time Agency does not have sufficient funds available <br /> and authorized to fulfill its obligations under this Agreement, Agency will use its <br /> best efforts to obtain such funds, but Agency's ability to continue to fulfill its <br /> obligations in the future under this Agreement is dependent upon Agency <br /> continuing to have sufficient funds or receiving sufficient appropriations and <br /> limitations or other funds and expenditure authority. <br /> 5. Workers Compensation. All employers, including Agency and its <br /> subcontractors, that employ subject workers who work under this Agreement in <br /> the State of Oregon shall comply with ORS 656.017 and provide the required <br /> Workers' Compensation coverage unless such employers are exempt under <br /> Key 14259 Page 6 of 17 <br />
