INTERGOVERNMENTAL AGREEMENT <br />( Autzen Stadium Expansion - Parking, Transportation, Parks and Related Issues) <br />This Agreement is entered into by and between the City of Eugene, a political subdivision <br />of the State of Oregon, hereinafter referred to as "City," and the State of Oregon, acting by and <br />through the State Board of Higher Education, on behalf of the University of Oregon, hereinafter <br />referred to as "University." <br />RECITALS <br />A. University owns, and schedules several University football games at, Autzen Stadium <br />each year. Occasional special events are also scheduled at Autzen Stadium. <br />B. City owns Alton Baker Park, which lies along the north bank of the Willamette River, <br />between University's main campus and Autzen Stadium. <br />C. University has proposed an expansion of the seating capacity at Autzen Stadium <br />which, under the Eugene Code in existence at the time of the proposal, would require that University <br />provide for additional automobile parking spaces and additional short and long -term bicycle parking <br />spaces. <br />D. The Eugene City Council has amended the Eugene Code to authorize a lesser number <br />of automobile and bicycle parking spaces than would otherwise be required under the Eugene Code, <br />so long as a City- approved intergovernmental agreement incorporating a transportation demand <br />management plan ( "TDM Plan") for the Autzen stadium complex (as defined in Eugene Code <br />section 9.015) is in effect, under certain conditions described below. <br />E. University and City enter into this Intergovernmental Agreement ( "IGA ") to <br />incorporate a TDM Plan on and subject to the conditions and other provisions of this IGA, which <br />conditions and other provisions address certain parking, public transit, litter, parks, and other related <br />issues in connection with the proposed expansion of Autzen Stadium. <br />AGREEMENT <br />City and University agree that: <br />1. Incorporation of TDM Plan; Definitions <br />1.1 The TDM Plan attached hereto as Exhibit 1 is hereby incorporated in this IGA, subject to <br />each of the conditions and other provisions set forth below in this IGA.
