(Babe Ruth) was signed in November 1997 to establish roles and responsibilities <br /> regarding the development and operation of the park. It has been determined that a supplement <br /> to this original agreement would be helpful to both parties in clarifying details that have arisen <br /> during the design and construction phases. The purpose of this letter is to summarize various <br /> facility design decisions that have been made for the purpose of economy or operational <br /> simplicity, and which result in the need for cost sharing. This discussion of key issues should <br /> provide a basis for the supplemental lease agreement. The Babe Ruth representatives are <br /> encouraged to include other issues which they feel a supplemental agreement should address. <br /> To paraphrase the original agreement and discussions that have occurred during development <br /> planning: Babe Ruth is responsible for design, construction and maintenance of all <br /> improvements in the baseball complex out to and including the outfield fences. The City is <br /> responsible for bringing various utility services to the vicinity of the ballfields where connections <br /> by Babe Ruth can be made, and otherwise to be responsible for park development and <br /> maintenance beyond the outfield fences. In requesting utility services for the ballfield complex, <br /> the installation costs have been paid by the City (as per the lease agreement), and the billing for <br /> service used has been set up for payment by Babe Ruth (as per the lease agreement). <br /> 1. Electrical construction: Two separate electric services are to be provided, one for Babe <br /> Ruth and one for the remainder of the park. The City and Babe Ruth will each pay the <br /> cost of the service equipment serving their facilities. Service panels will be located under <br /> the grandstand, with separate metering for each panel. Construction for the City's park <br /> portion is to be done simultaneously with the Babe Ruth construction. Electrical load <br /> calculations by L.H. Morris Electric Inc. have determined that the City's share of the <br /> main service from the transformer to the meters is 20 %. The cost of all City related work <br /> will be billed to the City of Eugene, (Attn.: Louis Kroeck, PW Engineering Division, 858 <br /> Pearl Street, Eugene, OR 97401). If two wells are installed for irrigation, the pumps are <br /> to be connected one each to the Babe Ruth electric service panel and City service panel. <br /> If only one well is realized then it will be connected to the City service panel with the <br /> City paying the monthly charge. <br /> Bethel Community Park March 31, 2000 <br /> 1 <br />
