INTERGOVERNMENTAL AGREEMENT <br /> for the <br /> JOINT USE AND DEVELOPMENT OF <br /> YOUTH SPORTS PARKS AND ATHLETIC FIELDS <br /> BETWEEN: School District 4J, a unit of local (District) <br /> government of the State of Oregon <br /> AND: The City of Eugene, a unit of local (City) <br /> government of the State of Oregon <br /> RECITALS <br /> 1. ORS 190.010 provides that units of local government may enter into agreements for the <br /> performance of any and all functions and activities that any party to the agreement, its assigned <br /> personnel or agents have authority to perform. <br /> 2. City and District have successfully shared the use, operation and maintenance of facilities <br /> for many years and desire to share resources and work collaboratively to jointly develop and <br /> manage the youth sports parks and athletic fields described in this agreement. <br /> 3. City and District enter into this agreement in the spirit of cooperation and with the <br /> commitment that the shared facilities will be used extensively by the community, especially by its <br /> children and youth, and that they will be maintained in good repair for many decades to come. <br /> AGREEMENTS <br /> Section 1: Development <br /> 1.1 Fields. Artificial surface multi -use athletic fields ( "artificial surface fields ") suitable <br /> for high school football and soccer will be constructed at Churchill High School, North Eugene <br /> High School, Sheldon High School, and South Eugene High School. <br /> 1.2 Youth Sports Parks. Youth Sports Parks will be constructed at Cal Young Middle <br /> School, Churchill High School, and Sheldon High School. Youth Sports Parks may include such <br /> features as upgraded natural surface fields, accessible basketball courts, skateboard [parks] <br /> facilities, improved tennis courts, picnic tables, accessible outdoor bathrooms, walks, plantings, <br /> fences, and ;night -use low -glare lighting. <br /> 1.3 Project Management. District shall manage the development and construction of <br /> the Youth Sports Parks and artificial surface fields in consultation with City as specified in a <br /> Draft Intergovernmental Agreement: Joint Use And Development of Youth Sports Parks and Athletic Fields <br /> November 19, 1999 <br /> Page 1 of 10 <br />
