1.3 Project Management. District shall manage the development and <br /> construction of the fields in consultation with City as specified in a separate agreement. <br /> The separate agreement will specify the conditions under which City will provide a <br /> project manager. <br /> Section 2 Length of Agreement. <br /> 2.1 Original Term. The term of this Agreement shall commence on the date <br /> of this Agreement and continue for a period of thirty (30) years. <br /> 2.2 Ten Year Review. The Agreement shall be reviewed and modified as <br /> needed by City and District at least once every ten (10) years. <br /> 2.3 Renewal. After thirty (30) years the parties intend to continue the <br /> agreement on terms to be mutually agreed upon. <br /> Section 3 Investment <br /> 3.1 City. City's investment shall be $4 million to include design, permitting <br /> fees, testing, construction administration, project management, construction, and related <br /> costs. <br /> 3.2 District. District's investment shall be $3.5 million plus up to $1.1+ <br /> million in cash, materials, or labor donations plus costs associated with project and <br /> financial management. <br /> 3.3 Associated Costs. City's investment shall not support costs associated <br /> with seating for 1,000, sound systems, score boards, goal posts, and fencing for the <br /> artificial surface field, ticket booths, and access to the artificial surface field. <br /> Section 4 Ownership <br /> City and the District agree that District shall own facilities located on District <br /> property and City shall own facilities located on City property. <br /> Section 5 Use <br /> 5.1 Initial Use of Multi- Purpose Artificial Fields. <br /> (1) The matrix included as Appendix A shall govern initial use by City, <br /> District and community of the multi - purpose artificial athletic fields. Times reserved <br /> for the District, but not used by the District, will be made available to City and <br /> Community and times reserved for the community, but not used by the community, will <br /> be made available to District.
