Risk Manager
200 N Monroe Street
Eugene. OR 97402 -4295
RE: Athletic fields and skateboard parks
Dear David.
There seems to be some confusion as to what Cramer & Giles and Marsh's recommendations
are on the integration of the athletic fields/skateboard parks with 4J and the City of Eugene.
As you may recall. I sent you an email back in November where 1 had suggested that t he
skateboard parlcs be the responsibility of the City and the athletic fields be the responsibility of 4J
School District. It was my understanding that idea received a warm reception With both 4J and
the City of Eugene at a very high level.
The City is now indicating that Bob and I had suggested that the City would have to change all of
its maintenance agreements if in fact we went with the recommendations above. As I indicated to
you. neither Bob nor I recall telling the City that they would have to change their maintenance
agreements to make this work.
The bottom line is that if the City takes the primary responsibility of the skate parks (1 still believe
that making them a city park is the most efficient way to handle this) and if 4J takes primary
responsibility of the athletic fields. Bob and 1 can work out any issues in regards to dovetailing the
insurance.
We realize that there will be issues wherein [Here may be some overlapping of Liability. However_
since both of you are public entities and not in the business of one entity trying to take advantage
of another. such as in the private sector, we believe that any unforeseen problems that could
arise out of these two venues can be resolved. If we have to "tweak" some of our insurance and
hold harmless languages. we can always do so down the road.
If you have any runner Questions. please do not hesitate to call.
Sincerely.
Ronald R.
