Monroe St. <br /> Eugene, OR 97402 -4860 <br /> Youth Sports Parks and Athletic Fields IGA (#00 00427) <br /> Dear David: <br /> This is a follow -up to our conversation last month about risk issues related to the <br /> Intergovernmental Agreement (IGA) between the City and 4J regarding the Youth Sports Parks <br /> and Athletic Fields. As I mentioned, Cathy Joseph and I met with City Public Works Maintenance <br /> and LRCS managers and with the City Manager and his staff to discuss the Facility Use <br /> Agreement proposal that Marsh and Cramer & Giles developed last November. Although the <br /> City is not comfortable with that proposal for a variety of reasons, we are sympathetic to 4J's <br /> concerns that, as the property owner, you will have sole responsibility for Youth Sports Parks <br /> premises liability claims under the current IGA. <br /> Therefore, the City of Eugene is willing to amend the indemnification language in section 14 of <br /> the IGA and agree to defend, indemnify and hold 4J harmless from claims that do not arise from <br /> 4J's negligence, as specified in the amendment. I am enclosing a copy of the proposed <br /> amendment for your review. Please let me know if this language is acceptable to you. <br /> The City also hopes that 4J will move ahead and adopt a version of our park rules as outlined in <br /> Jim Croteau's November 29, 2000 letter to Bill Hirsh so that the Eugene Police Department can <br /> begin enforcement of the rules. I am enclosing a copy of Jim's letter for your information. <br />
