Oregon law allows loans to be made from <br /> one fund to another, so long as loans are repaid no later than the end of the <br /> ensuing year. <br /> The superintendent recommends adoption of the resolution, which was <br /> included in your June 1 packet, authorizing the district to utilize interfund <br /> borrowing during the 1999 -2000 school year. <br /> d. Designate School Depositories for Fiscal Year 1999 -2000 <br /> It is necessary for the Board of Directors to designate depositories for the 1999- <br /> 2000 fiscal year. A copy of the resolution, which includes a list of the <br /> depositories, was included in your June 1 packet. <br /> The superintendent recommends adoption of the resolution designating <br /> depositories for School District 4J, effective July 1, 1999 through June 30, 2000. <br /> e. Appoint Legal Counsel and Auditor for Fiscal Year 1999 -2000 <br /> General legal services are being provided for the district by Joe Richards of the <br /> law firm Luvaas, Cobb, Richards, & Fraser, and auditing services are being <br /> provided by Grove, Mueller, Hall, and Swank. We continue to be satisfied <br /> with the services we receive from both firms. <br /> The superintendent recommends that Joe Richards be retained as legal counsel <br /> for the 1999 -2000 fiscal year. The superintendent further recommends that <br /> Grove, Mueller, Hall, and Swank be appointed to conduct the 1998 -99 annual <br /> audit, as required by Oregon Statute. <br /> 4. Award Contract for Roofing and Seismic Improvements at Seven Schools <br /> Bids for roofing and seismic projects at seven schools were opened on May 27, <br /> 1999: Howard, Santa Clara, Willakenzie, Willagillespie, North, Gilham and Spring <br /> Creek. The construction budget was established at $800,000. Four firms <br /> submitted bids as follows: <br /> FIRM BID AMOUNT <br /> Pacific Tech Construction $668,798 <br /> Morris P. Kielty $696,047 <br /> McKenzie Commercial Contractors $603,800 <br /> Preferred Construction $646,758 <br /> The low bidder, McKenzie Commercial Contractors, has requested that it be <br /> allowed to withdraw its bid pursuant to Oregon Attorney General's Model Public <br /> Contract Rules, Division 30, section 137 - 030- 0075(2d) which states; "An Agency <br /> may permit an Offeror to withdraw an Offer based on other errors only if Offeror <br /> shows by clear and convincing evidence: (i) the nature of the error, and (ii) that the <br /> error is not a judgment error, minor informality or clerical error." McKenzie <br /> Contractors has shown to our satisfaction that they made a substantial error in its <br /> bid by failing to include a sizable quantity of sheathing. <br />
