Robert and Violet Fraser
1858 Fircrest Drive
Eugene, OR 97403
•
November 3, 1997
Jonathan M. Raney
259 E. 5th, Suite 200
Eugene, OR 97401
Re: Hendricks Park Trees f f
Dear Mr. Rainey:
On at least two occasions where I heard you discuss the tree situation you have mentioned
that you are a lawyer. You will note I have not. As you are aware, the Tort 'Claims Act has
a limitation of liability for $200,000 for injury and death and $50,000 for property damage. I
have read with interest and listened with a close ear relative to charges against the City and the
Urban Forester. Your committee is an ad hoc committee, has not been appointed by the City
Council or any official organ of the City, and it is my view that you act without authority.
Because of the above - referenced liability, and your lack of official status, I wish to place you
on notice and anyone else on your committee that you care to inform that in the event any injury
is suffered by my family or my home that is not covered by the City's liability I will look to
each of you individually for interfering in the risk analysis related to these trees.
I would be obliged if you would put your homeowner's liability company on notice and
also your comprehensive general liability carrier. Thank you.
ery truly urs,
0 4110
Re. .
RHF /kre
