I believe the language is
consistent with the IGA and the intent of both parties. I believe Cathy in your risk
department will want to review this, as will, no doubt, your legal counsel. This has already
been reviewed by the District administration and legal counsel. (It is concurrently being sent
to David Brewer, the District's Risk Manager).
There is a second item which was discussed at the last meeting of the User Committee.
The proposed language matches, I believe, the understanding in principle that Jeff
Lankston and I currently have. Please review the specific language.
•
Add a new section 5.25: Operation of Park Components of Youth Sports Parks. Both
parties to this IGA agree and acknowledge that the following Youth Sports Park
components will be operated as City Parks, subject to City Parks regulations that are not in
conflict with this Intergovernmental Agreement (IGA). Youth Sports Park components to be
considered as City parks: Designated areas created at CHS as part of this agreement,
including the circular outdoor basketball court, the skate bowl, the playground, the outdoor
public restrooms, and connecting walkways and landscaping; and the entire YSP created at
CYMS as part of this agreement. Wherever there is a conflict between the IGA and Parks
regulations, the IGA shall govern, except as City and District officials shall mutually agree.
Delete 8.4 (2) in entirety, and replace with: "District shall receive twenty percent (20 %) of
Ot the o concessions cket eipt ve, cored „ City gr o r District , and those and athletic ti activ rec from of approved all ents
youth ex ept sports for those groups spons while approved by the
{
"` youths sports groups are the only participants. All such revenue will be used for
maintenance and operation of or custodial services for the facilities described in section 1 of
this Agreement, as mutually agreed by the City and District.
10/9/00
