City /State <br /> Agreement No. 26470 <br /> intermittent inspection services during the construction phase of the <br /> Project. The actual cost of laboratory testing service provided by <br /> the State will be charged to the Project construction engineering <br /> expenditure account and will be included in the total cost of the <br /> Project. <br /> c) Provide preliminary engineering and preliminary cost estimates for <br /> the Project. <br /> 3. The State will review all right of way activities engaged in by the City to <br /> assure compliance with applicable State and Federal laws and <br /> regulations. <br /> 4. If any real property purchased by State or City with federal -aid participation is <br /> no longer needed for the original authorized purpose, the disposition of <br /> such property shall be subject to applicable rules and regulations which <br /> are in effect at the time of disposition. <br /> 5. State is responsible for seeing that all Project right -of -way monumentation <br /> will be conducted in conformance with ORS 209.155. <br /> 6. State and City grant each other authority to enter onto the other's right of way <br /> for the performance of the Project, and subsequent use by the City of <br /> the bike - pedestrian improvements subject to these conditions. <br /> 7. Following final construction of GCP, City shall be responsible for all <br /> maintenance and operations work required on the Springfield- Eugene <br /> portions of the Glenwood Connector Path and the grade immediately <br /> adjacent as described in Exhibit A. This includes but is not limited to <br /> noxious weed removal, litter removal, repair or replacement of <br /> pavement, rails, retaining walls, signs, painting, lighting, damage to <br /> traffic appurtenances, which are caused by theft, vandalism, natural <br /> occurrences, acts of God, or normal wear and tear.
