City /State <br /> Agreement No. 26470 <br /> • State is responsible for care, maintenance, repair, removal <br /> and /or disposal of Design Enhancements that are <br /> constructed and placed above, or next to the 1 -5 roadway <br /> or in the median between north and south bound lanes, <br /> within State right of way. (City has no responsibility or <br /> authority for these Design Enhancements so placed.) <br /> State may develop third party agreements for maintenance <br /> of Design Enhancements under programs such as "Adopt <br /> A Highway" at State's discretion. <br /> • At such time as any Design Enhancements are going to be <br /> proposed by the local community and accepted by the City <br /> for care and maintenance, a written detailed summary of <br /> each Design Enhancement, agreed characteristics, <br /> expected life cycle, maintenance plan, maintenance <br /> budget amount, and location of said Design Enhancement, <br /> will be provided by the State and amended into this <br /> Intergovernmental Agreement to be executed by both <br /> parties. <br /> C. STATE OBLIGATIONS <br /> 1. PROJECT FUNDING <br /> a) The State will pay those costs of the GCP utilizing Statewide <br /> Transportation Improvement Program (STIP), federal -aid funding <br /> approved for Key No. 14259, and Transportation Enhancement <br /> funds approved for this Project. <br /> b) State represents that at the time this Agreement is written sufficient <br /> funds are available and authorized for State to fulfill its obligations <br /> under this Agreement. <br /> 2. Regarding the GCP, the State will: <br /> a) Review, approve, or comment on all environment statements, <br /> permit applications, preliminary and final plans, specifications and <br /> cost estimates prepared by the City. The State will, if they prepare <br /> these documents, offer the City the opportunity to review and <br /> comment on the preliminary and final documents prior to release <br /> and advertising for bids. <br /> b) The State will prepare contract and bidding documents, advertise <br /> for bid proposals, award all contracts and, upon award of a <br /> construction contract, perform all necessary laboratory testing of <br /> materials, process and pay all contractor progress estimates, check <br /> final quantities and costs, as well as oversee and provide <br /> Key 14259 Page 5 of 14 <br />
