City /State <br /> Agreement No. 26470 <br /> • Construction costs for Design Enhancements will be paid <br /> by State. As currently scoped, all of the WRB Design <br /> Enhancements will not exceed a collective value of <br /> $1,200,000.00. <br /> • The City will provide input in the expected design, <br /> construction, maintenance schedule, life expectancy, <br /> replacement and /or disposal responsibilities, as a part of <br /> their review and acceptance of the maintenance and <br /> management of any Design Enhancements within the <br /> . City's control. <br /> • If the City no longer can manage or maintain a particular <br /> Design Enhancement, and no public support can be <br /> garnered to provide needed maintenance or repairs, the <br /> City will remove the Design Enhancement from the State <br /> right of way upon request from the State.- State may also <br /> elect to assume all responsibility for specific Design <br /> Enhancements within the State right of way at its <br /> discretion and upon written notice to City, thereby <br /> terminating further City responsibility or authority over the <br /> particular Design Enhancement. State has no authority or r' <br /> responsibility over Design Enhancements accepted and <br /> placed on City property following their placement. <br /> • Design Enhancements which have been accepted by the <br /> City, and are under the responsibility of the City, shall be <br /> maintained by City or a designee. The terms of the <br /> acceptance, or modification to the terms, shall be mutually <br /> agreed upon by both Parties. <br /> • In any case, any Design Enhancements which are not <br /> accepted by the City or approved may or may not be <br /> constructed, at the State's discretion. City has no <br /> obligation for care or maintenance for Design <br /> Enhancements that it has not accepted. <br /> • State and City agree to evaluate the expected costs to <br /> maintain, and care for specific Design Enhancements <br /> during an expected life cycle, and which may fall under the <br /> jurisdiction of the City. State will provide a one time <br /> payment of up to 10% of the value of the Design <br /> Enhancement, to be used at the City's discretion, for the <br /> on -going maintenance and care during expected life of the <br /> Design Enhancement. <br /> Key 14259 Page 4 of 14 <br />
