City /State <br /> Agreement No. 26470 <br /> Project, the State may further act for the City in other matters <br /> pertaining to the Project. <br /> a) State and City shall each assign a liaison person to provide Project <br /> monitoring throughout all phases of Project activities, coordinate <br /> activities, and assure that the interests of both parties are <br /> considered during all phases for all projects. <br /> 2. PRELIMINARY & CONSTRUCTION AND ENGINEERING <br /> a) The preliminary and construction engineering will be performed <br /> primarily by the State for the GCP. The State will ensure the work is <br /> in conformance with FHWA rules and guidelines. In the event that <br /> the State elects to engage the services of a consultant to perform <br /> any of the work covered by this Agreement, State and the <br /> consultant shall enter into an agreement describing the work to be <br /> performed and method of payment. The State will provide all <br /> permits for the GCP, as they relate to the Project. <br /> 3. UTILITIES <br /> a) State shall relocate or cause to be relocated or reconstructed, all <br /> privately or publicly -owned utilities, conduits, lines, poles, mains, <br /> pipes, and such other facilities of every kind and nature where such <br /> relocation or reconstruction is made necessary by the plans of the <br /> Project in order to conform the utilities and other facilities with the <br /> plans and the ultimate requirements of the Project, provided utilities <br /> fall within the State's right of way, jurisdiction, and control. <br /> b) Only those utility relocations which are eligible for federal -aid <br /> participation under the Title 23 CFR 645A, shall be included in the <br /> total Project costs. <br /> c) The State will arrange for utility relocations /adjustments in areas <br /> lying within jurisdiction of the State. <br /> 4. MEMORANDUM OF UNDERSTANDING, (MOU) REGARDING DESIGN <br /> ENHANCEMENTS <br /> At a point in the future, the local Eugene - Springfield community will <br /> provide specific WRB Project Design Enhancements,- some of which <br /> may be included into the area for which the City will be responsible to <br /> maintain. Because the specifics of the Design Enhancements are not <br /> known at this time, it is therefore difficult to define the detailed <br /> requirements for their care and maintenance:.
