City /State <br /> • <br /> Agreement No. 26470 <br /> 1. Under such authority, State and City desire to enter into this Agreement <br /> regarding use, construction and maintenance of the GCP, by the State, <br /> and City. The responsibility for management and maintenance of all <br /> portions of the GCP from the centerline of the 1 -5 right of way, westward to <br /> the Knickerbocker footbridge shall be the City's following construction <br /> work. <br /> 2. State shall be responsible for the design and construction of the GPC. <br /> 3. All of the foregoing work is hereinafter referred to as the Project. The <br /> Project is shown on Exhibit A — Project Area, attached hereto and by this <br /> reference made a part hereof. <br /> 4. Project costs coming as a result of construction, and maintenance, of the <br /> GCP are covered as follows: <br /> a) Construction — GCP Construction costs shall be paid by State as <br /> depicted in State's final Bundle 220, P -20 plans, specifications, and <br /> estimates. <br /> • Any future improvements /modifications made to the newly <br /> constructed GCP that fall within State's right of way must <br /> be approved by State and costs pursuant to any <br /> improvements /modifications shall be paid for by City. <br /> b) Maintenance — Maintenance costs of the newly constructed GCP <br /> will be paid by City including portions of the GCP that are located <br /> on State's right of way. <br /> 5. The term of this Agreement shall begin on the date all required signatures <br /> are obtained and shall be in effect as long as the path exists. <br /> 6. This Agreement may be modified by mutual consent of both parties and <br /> upon execution of amendments to his Agreement stating said <br /> modifications. <br /> B. JOINT OBLIGATIONS <br /> 1. PROJECT ADMINISTRATION <br /> a) State is acting to fulfill its responsibility to the Federal Highway <br /> Administration (FHWA) by the management of this Project, and City <br /> hereby agrees that State will have full authority to carry out this f, <br /> administration.
