State /Eugene Bike - Pedestrian Glenwood pathway Agreements No.: 26469 <br /> INTERGOVERNMENTAL AGREEMENT <br /> Project Name: Willamette River Bridge - Revised Glenwood Connector Path <br /> THIS Agreement is made and entered into by and between the STATE OF <br /> OREGON, acting by and through its Department of Transportation, hereinafter <br /> referred to as "State ", and the CITY OF EUGENE, acting by and through its <br /> Public Works, hereinafter referred to as "City ", collectively hereinafter referred to <br /> as the "Parties ". <br /> RECITALS <br /> 1. By the authority granted in Oregon Revised Statute (ORS) 190.110, state <br /> agencies may enter into agreements with units of local government for the <br /> performance of any or all functions and activities that a party to the <br /> agreement, its officers, or agents have the authority to perform. <br /> 2. State has jurisdiction of the right of way on which the current Glenwood <br /> Connector Path (GCP) is constructed and where the new alignment of the <br /> GCP - proposed trail and viaduct will be constructed, but State does not <br /> have the resources available to maintain the path. <br /> 3. The existing GCP includes a 12 -foot wide asphalt path with directional <br /> signing- signage and path lighting. This existing path was constructed by <br /> the State in 1995. The parties have an existing Intergovernmental <br /> Agreement, Number 17289, which will be superseded by this Agreement. <br /> 4. During the reconstruction of the Willamette River Bridge (WRB) which <br /> started in 2009, the GCP path was realigned to avoid construction work. <br /> The State will continue to make provisions for temporary realignments <br /> through the WRB replacement period, and may close the path for short <br /> periods of one day or less to minimize risks to the public. The current GCP <br /> alignment will ultimately be closed upon completion and placement of the <br /> new GCP alignment into service. At a later time and-at its expense, City <br /> may elect to restore old GCP alignment under the terms of this <br /> agreement. <br /> 5. This Agreement concerns the design, permitting, construction, and <br /> maintenance of the GCP trails west of the centerline of the 1 -5 and within <br /> the State right of way. The western GCP portion will be designed by the <br /> State. The GCP will be constructed by the State. <br /> NOW THEREFORE the premises being in general as stated in the foregoing <br /> RECITALS, it is agreed by and between the parties hereto as follows: <br /> A.
