(WG 95 -1) <br /> Tax Lots 700 and 800 -- Assessor's Map 17- 04 -25 -13 <br /> Located north of Thomason Lane and east of River Road, with access <br /> from Fir Lane. <br /> Request is to allow development of a day care facility on property <br /> located in the Willamette Greenway. The site is zoned RA Suburban <br /> Residential. <br /> Applicant: City of Eugene Parks Services of the Public Works <br /> Department and Child Care, Inc. <br /> The following findings of fact and conclusions of law are based <br /> upon testimony presented at the public hearing of December 20, 1995 <br /> and materials and documents submitted and made part of the planning <br /> department file through the close of the record. <br /> DECISION DATE: January 3, 1996 <br /> APPEAL DEADLINE: January 15, 1996 <br /> CONCLUSION: The application to allow development of a day care <br /> facility on property located in the Willamette Greenway is denied. <br /> DISCUSSION AND FINDINGS <br /> The denial herein is based upon the findings in the concurrent <br /> conditional use permit application (CU 95 -8). Findings there are <br /> made that the criteria for approval of a variance are not met. The <br /> development as proposed is only possible if a variance is granted. <br /> Therefore, it would be meaningless to evaluate the specific <br /> proposal in the context of the Willamette Greenway criteria. <br /> Res ectfull - ted, <br /> J• W.
