FINDINGS OF HEARINGS OFFICIAL Child Care, Inc. (CU 95 -8) Tax Lots 700 and 800 -- Assessor's Map 17- 04 -25 -13 Located north of Thomason Lane and east of River Road, with access from Fir Lane. Request for a conditional use permit to allow a day care facility in an RA Suburban Residential zoning district. Applicant: City of Eugene Parks Services of the Public Works Department and Child Care, Inc. The following findings of fact and conclusions of law are based upon testimony presented at the public hearing of December 20, 1995 and materials and documents submitted and made part of the planning department file through the close of the record. DECISION DATE: January 3, 1996 APPEAL DEADLINE: January 15, 1996 CONCLUSION: A conditional use permit to allow a day care facility in an RA Suburban Residential zoning district is denied. DISCUSSION AND FINDINGS A. Findings of Fact The applicant proposes a day care facility for approximately 48 children and involving 7 to 10 staff members. The facility is proposed to have a floor area of approximately 5,500 square feet on a development site containing approximately 27,500 square feet. The structure would be located in compliance with front and interior yard setback requirements of 10 and 5 feet, respectively, and would not have a lot coverage exceeding 50% of the lot. The site would contain accessory uses including a sheltered play area and perimeter landscaping. The development site has frontage along the north side of Thomason Lane which would only be used for service deliveries. An integral part of the proposed use is the provision of parking for staff and patrons on the adjacent 77 space parking lot for the Maurie Jacobs Memorial Park located immediately north of the site.
