Lot 3100 is zoned PL and is noted on the Metro Plan and the adopted neighborhood <br /> is designated for public use. The existing parking area associated with the Maurie <br /> Jacobs Park provides compliance. Therefore, based on these findings, the proposal <br /> is inapplicable to the above criterion. <br /> 2. Establishment of adequate setback lines to keep structures separated <br /> from the River to protect, maintain, preserve, and enhance the natural, <br /> scenic, historic, and recreational qualities of the Greenway. Setback <br /> lines need not apply to water related or water dependent activities as <br /> defined int he Statewide Planning Goals and Guidelines (OAR 660 -15- <br /> 000 et seq.). <br /> A portion of the City of Eugene park acquisition along the west bank of the <br /> Willamette River and recognized as Maurie Jacobs Park is located between the <br /> proposal and the west bank of the Willamette River approximately 600 feet to the <br /> east. Existing park facilities administered by the City of Eugene adequately <br /> maintain a setback from the Willamette River, ensuring protection and preservation <br /> as defined in Statewide Planning Goals and Guidelines noted in the above criterion. <br /> Therefore, no additional setback protection is applicable for the subject request. <br /> 3. Protection of significant fish and wildlife habitats as identified in the <br /> Metropolitan Plan Natural Assets and Constraints Working Paper. Sites <br /> subsequently determined to be significant by the Oregon Department of <br /> Fish and Wildlife shall also be protected. <br /> The area subject to this request is not identified on Figure D -2 of the Natural Assets <br /> and Constraints Working Paper as being in a significant wildlife area, fish area, bird <br /> flyway, or a known endangered, threatened, or rare plant or wildlife area. This <br /> finding corresponds to the Metropolitan Natural Resource Special Area Study. The <br /> existing park improvements between the development site and the Willamette River <br /> mitigates construction issues, i.e., erosion or tribidity issues of the proposed care <br /> facility affecting the Willamette River. Therefore, based on these findings, the <br /> subject request is in compliance with the above criterion. <br /> 4. Protection and enhancement of the natural vegetation and fringe along <br /> the river to a maximum extend practicable. <br /> The proximity of the Willamette River and existing park development in this setback <br /> area does not locate the development site in a fringe area along the river. <br /> Protection enhancement of the natural assets between the subject request and the <br /> Willamette River are being administered for the existing public park development. <br /> Based on this information, the proposal is in compliance with the above criterion. <br /> STAFF REPORT -- Eugene Hearings Official March 25, 1996 11 -11 <br />
