Policy 5. Page III -D -4: New development that locates along the river <br /> corridors and waterways shall be limited to uses that <br /> are compatible with natural, scenic, and <br /> environmental qualities of those river features. <br /> The subject request will involve new development. However, as previously noted, <br /> the site is located approximately 600 feet west and southwest of the westerly bank <br /> of the Willamette River. By virtue of the site's proximity to the river and existing <br /> residential development to the east, south, and west, the parcel is not in a location <br /> characterized as being in the Willamette River Corridor. The reference of river <br /> corridors and waterways in the above policy address a geographic area associated <br /> with the Willamette River and adjacent land providing a passageway or route. <br /> Based on these findings and those referenced in the Conditional Use Evaluation in <br /> this report under Section 9.702(d) above, the proposed development conforms to <br /> applicable policies contained in the Willamette Greenway Element of the Metro Plan <br /> III -D -4 and extending onto Page III -D -5. <br /> Section 9.260(2)(d): The intensification, change of use, or <br /> development will conform with either (I) an adopted refinement plan or <br /> ordinance that imposes use management requirements consistent with <br /> Statewide Goal 15, or (ii) the use management considerations and <br /> requirements under Statewide Goal 15 as measured by the standards <br /> below: <br /> The area of this request is located within the boundaries of the River Road /Santa <br /> Clara Urban Facilities Plan. The above criterion states that the proposed request <br /> shall conform to either an adopted refinement plan consistent with Statewide Goal <br /> 15 or be evaluated addressing the State Goals. Since the neighborhood plan does <br /> not address other use management considerations consistent with Statewide Goal <br /> 15, the proposed development will be evaluated addressing these use management <br /> considerations and requirements. They are as follows: <br /> 1. "Preservation and maintenance of any designated agricultural land as <br /> provided in Statewide Goal 3. (The inventory conducted in 1976 to <br /> establish the boundary of the Willamette River Greenway indicated that <br /> "there is no land with the Eugene City limits which falls within the <br /> definition of agricultural lands ... all land within the City is committed to <br /> urban use. "). <br /> Tax lots 700 and 800 subject to this request are zoned RA Suburban Residential <br /> and are located inside the city limits. As previously noted in the Conditional Use <br /> Evaluation portion of this report, both the neighborhood plan and the Metro Plan <br /> designate this area of the request as appropriate for low- density residential.
