Day care facilities are considered a suitable use in Low - Density Residential zoning <br /> districts such as the RA district applicable to the subject site. The following <br /> policies in the Metro Plan text support the proposed use: <br /> Residential Land Use and Housing Element Policy 16, Page III -A -1: <br /> Encourage location of nonresidential uses, such as neighborhood commercial <br /> and small -scale light industrial, within residentially designated areas when <br /> those auxiliary uses are compatible with refinement plans, zoning ordinances, <br /> and other local controls for allowed uses in residential neighborhoods. <br /> Day care facilities are considered auxiliary uses in residentially designated areas in <br /> that they provide for a needed service in close proximity. The proposed day care <br /> facility in a residential area complies with the above policy and is compatible with <br /> the individual neighborhood based on the findings of this report, including the <br /> Applicants Statement incorporated by reference. <br /> The subject request has been submitted addressing the provisions in the Eugene <br /> Code which allow day care in all residential zoning districts provided the request is <br /> in compliance with the Conditional Use Permit criteria. <br /> Evaluation Willamette Greenway <br /> As noted earlier in this report, the subject request also involves Willamette <br /> Greenway Evaluation. Section 9.260(1) of the Eugene Code requires that <br /> development of land within the corporate limits of the city and the boundaries of <br /> the Willamette River Greenway be accomplished in accordance with the Planned <br /> Unit Development regulations or Conditional Use procedures. The Conditional Use <br /> procedure is consistent with Section 9.260(1) of the Eugene Code in that day care <br /> facilities shall be reviewed utilizing the Conditional Use procedures previously <br /> addressed in this report. Therefore, the following Willamette Greenway Evaluation <br /> and the preceding Conditional Use Permit procedure is consistent with code <br /> requirement addressing the following criteria in Section 9.260(2) of the Eugene <br /> Code: <br /> 9.260(2)(a): To the greatest degree possible, the intensification, change of <br /> use, or development will provide the maximum possible landscaped area, <br /> open space, or vegetation between the activity and the River. <br /> The Willamette River Greenway in the area of the proposed development site <br /> extends west to River Road, encompassing parkland and residential development <br /> extending along Thomason Lane, Fir Lane, Lombard Lane, and Briarcliff Lane. The <br /> west bank of the Willamette River is located approximately 600 feet to the east and <br /> northeast from the northerly boundary of the development site.
