will provide a method of acknowledging Transportation's <br /> concerns for additional widening for a portion of Fir <br /> Lane. <br /> 2. The applicant shall contact the Eugene Fire Marshal addressing <br /> the location of a fire hydrant and installation as necessary. <br /> The applicant shall present a confirmation letter regarding <br /> fire protection to the Planning Division prior to staff <br /> preparation of the Conditional Use Permit Agreement. <br /> 3. Provide a minimum of nine vehicular parking spaces for the <br /> development on a continuing basis. <br /> 4. The detached play shelter .cannot be more than 15 feet in <br /> height as defined by Eugene Code. In addition, no more than <br /> two detached accessory buildings can be located on the <br /> property. <br /> 5. The north identity sign cannot exceed 32 square feet in area <br /> and cannot be higher than 5 feet above grade. The "service <br /> only" sign on the south cannot exceed three square feet in <br /> area nor be higher than five feet above grade. <br /> 6. The use shall comply to noise standards set forth in Eugene <br /> Code Section 9.644. <br /> 7. Children in the outdoor recreation shall be supervised to <br /> prevent the throwing of materials, including toys, onto <br /> adjacent property. <br /> DISCUSSION AND FINDINGS <br /> A. Findings of Fact <br /> The proposal involves construction of a new building approximately <br /> 5,500 square feet in size to be located on Tax Lots 700 and 800. <br /> These two lots have approximately 27,500 square feet and are <br /> currently vacant and zoned RA. The building site has frontage <br /> along the north side of Thomason Lane and is adjacent to the <br /> existing 77 space parking area for Maurie Jacobs Memorial Park <br /> located to the north and east. Primary access and orientation of <br /> the day care facility is to the parking area to the north where <br /> access will be taken from Fir Lane. There will be service access <br /> by means of Thomason Lane. The proposed structure will not exceed <br /> 25 feet in height and is generally designed to be of a <br /> configuration not dissimilar to residential structures. <br /> A portion of the development site consists of the existing parking <br /> facility on Tax Lot 3100. This parking is associated with Maurie <br /> 2 - FINDINGS OF HEARINGS OFFICIAL (CU 96 -1) <br /> C: \FINDINGS \APRIL \CU -96 -1.403 (cjm) <br />
