B. Evaluation <br /> Section 9.260(2)(a): To the greatest degree possible, <br /> the intensification, change of use, or development will <br /> provide the maximum possible landscaped area, open space, <br /> or vegetation between the activity and the river. <br /> As indicated above, there is not much in the way of vegetation to <br /> be lost on the subject site itself. The existing landscaped area <br /> open space and vegetation between the activity on this site and the <br /> river will remain as before development. That vegetation is <br /> located within Maurie Jacobs Park. <br /> Section 9.260(2)(b): To the greatest possible degree, <br /> necessary and adequate public access will be provided <br /> along the river by appropriate legal means. <br /> The parkland immediately to the north of this site provides optimum <br /> access to and along the river by its provision of a parking lot <br /> with connection to River Road by Fir Lane providing immediate <br /> access to Maurie Jacobs Park. Access to the river is also provided <br /> by a pedestrian /bicycle path from the culdesac terminating Thomason <br /> Lane, Briarcliff Lane to the north, and N. Polk Street located to <br /> the southeast. The development proposed here does not alter or <br /> change the existing adequate access to the river in this area. <br /> Section 9.260(2)(c): The intensification, change of use, <br /> or development will conform with applicable Willamette <br /> Greenway policies as set forth in the Metropolitan Plan. <br /> The following policy for the Willamette River Greenway, River <br /> Corridor, and Waterway Element of the Metro Plan are applicable to <br /> the subject request: <br /> "New development that locates along the river corridors <br /> and waterways shall be limited to uses that are <br /> compatible with natural, scenic, and environmental <br /> qualities of those river features." (Policy 5) <br /> This development is not within the Willamette River Corridor itself <br /> as contemplated by the above plans and policies. To the extent <br /> that language is applicable, the proposed use will be compatible <br /> with the river features by virtue of the landscaping that will be <br /> placed on site and the existing vegetation and open space between <br /> the site and the river. <br /> Section 9.260(2)(d): The intensification, change of use, <br /> or development will conform with either (i) an adopted <br /> refinement plan or ordinance that imposes use management <br /> requirements consistent with Statewide Goal 15, or (ii) <br /> 2 - FINDINGS OF HEARINGS OFFICIAL (WG 96 -2) <br /> C: \FINDINGS \APRIL \WG -96-2.403 (cjm) <br />
