NOW, THEREFORE, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a <br /> Municipal Corporation of the State of Oregon, as follows: <br /> Section 1. Based on the above findings, which are hereby adopted, the City Manager is <br /> authorized to execute such documents necessary to transfer, for no monetary consideration, Tax Lots <br /> 700 and 800, Assessor's Map 17- 04 -25 -13 located on Thomason Lane, Eugene, Oregon, to Child <br /> Care Incorporated to be used to provide child care for families, including low income families, subject <br /> to the following conditions: <br /> (a) That Child Care Incorporated apply for and obtain a Conditional Use Permit <br /> for its intended use of the property within four years from the date of this Resolution; <br /> (b) That Child Care Incorporated provide confirmation to the City that at least <br /> 80% of the funding for the relocation project has been secured prior to commencement of <br /> construction of the project, and that the funding be confirmed, construction commenced, and <br /> the relocation occurs within five years from the c' .te of this Resolution. <br /> Section 2. In the event Child Care Incorporated fails to secure the Conditional Use Permit, <br /> funding, or relocation to the Thomason Lane site within the stated five -year period, title to the two <br /> parcels shall revert to or remain in the City's name. <br /> The foregoing Resolution adopted theA3 day of January, 1995. <br /> City Recorder <br /> Resolution - 2 <br />
