t , <br /> RESOLUTION NO. c ( 1 7Y2 <br /> A RESOLUTION AUTHORIZING THE TRANSFER OF CITY <br /> REAL PROPERTY LOCATED ON THOMASON LANE TO <br /> CHILD CARE INCORPORATED. <br /> The City Council of the City of Eugene finds that: <br /> A. The City is the owner of two undeveloped Tax Lots 700 and 800, Assessor's Map 17- <br /> 04-25-13, located on Thomason Lane abutting Maurie Jacobs Park. The two parcels total 0.6 acres <br /> with an assessed value of $35,570, and it has been determined that the parcels are not needed for <br /> expansion of the Maurie Jacobs Park, or otherwise needed by the City. <br /> B. Child Care Incorporated (CCI) is a community nonprofit preschool care center which <br /> has been operating since 1967 out of a City owned surplus residential structure in Skinner's Park at <br /> 169 North Washington Street. CCI's stated purpose is to provide high quality care services at an <br /> affordable cost for all families, with an emphasis on low income families, and purports to be the only <br /> facility open to all families in the Eugene /Springfield area providing tuition based on a true sliding <br /> scale, with payment according to family size and income. <br /> C. Consistent with its goals of providing assistance to low income families, the City has <br /> permitted CCI to use the structure at 169 North Washington Street rent free, and has also authorized <br /> the expenditure of funds to effect repairs to the structure in previous years. <br /> D. A recent analysis of the structure revealed that repairs and improvements costing <br /> approximat°ly $120,000 would be necessary to bring the structure into compliance with building <br /> safety conditions and the Americans with Disabilities Act. Continued use cf the structure within <br /> Skinner's Park by CCI is not in conformance with Federal Park and Recreation requirements imposed <br /> as a result of federal funds being used in the acquisition of the park. <br /> E. The public benefit to be derived from CCI continuing to provide low income sliding <br /> scale child care services within the Whiteaker neighborhood justifies the transfer of the two parcels <br /> on Thomason Lane to CCI without receiving the fair market value of die property. Such a transfer <br /> would also serve the public purpose of removing a non - conforming use from Skinner's Park and <br /> eliminate the revirement that the City effect repairs to the structure that exceed its value, and would <br /> provide CCI with an asset base that would facilitate its ability to receive grants and continue or <br /> expand the services it provides. <br /> F. It is therefore in the public interest that the two parcels on Thomason Lane be <br /> transferred to CCI, subject to the conditions contained in this Resolution. <br /> Resolution - 1 <br />
