REAL PROPERTY SALE AGREEMENT <br /> DATE: C 0,5A 3_1 , 1995 <br /> SELLER: City of Eugene, an Oregon municipal corporation ( "Seller" or "City") <br /> BUYER: Child Care, Inc. of Eugene, <br /> an Oregon nonprofit corporation ( "Buyer" or "CCI ") <br /> Recital <br /> A. Seller desires to sell to Buyer and Buyer desires to purchase from Seller <br /> certain real property with all improvements located on it commonly known as Tax Lots <br /> 700 and 800, Assessor's Map 17- 04- 25 -13, located in Lane County, Oregon (the <br /> "Property "), as more particularly described in Exhibit A which is incorporated herein by <br /> this reference. <br /> B. The public benefit to be derived from the transfer is that Buyer will be able <br /> to continue to provide low income sliding scale child care services within the Whiteaker <br /> neighborhood and have an asset base that would facilitate its ability to receive grants and <br /> continue to expand the services it provides. The transfer also removes a non - conforming <br /> use from Skinner's Park and eliminates the requirement that the City effect repairs to the <br /> existing CCI structure that exceed its value. <br /> Agreement <br /> Now, therefore, in consideration of the foregoing Recitals, which by this reference <br /> are incorporated herein as if set forth in full, and of the mutual covenants, conditions and <br /> obligations on the part of each party to be kept and performed, it is hereby. agreed as <br /> follows: <br /> Real Property Sale Agreement - 1 <br />
