DIRECTOR'S ORDER AND CONDmONS
<br /> By this order, the Director of the Division approves the Plan as a wetland
<br /> conservation plan under the following conditions:
<br /> 1. The Order shall become final when ordinances establishing buffers, waterside
<br /> protection and protection for acquired sites consistent with the Plan and permit
<br /> procedures consistent with this Order are adopted by the City.
<br /> 2. Wetland alteration for sites or portions of sites A3a, A3c, A4b, A4c, A4g, C3b,
<br /> C6a, C6b, C7, D2a, D2b, E3, F1, F2, G1, and 12b designated for development are
<br /> approved by this order according to ORS 196.681(7)(b) b) when approved by the city in
<br /> accordance with the approved Plan. Development of these sites will not require review
<br /> by the Division of State Lands except for boundary delineation. Approval of boundary
<br /> delineations by the Division of State Lands will be required for sites A3a, A3c, A4b, A4c,
<br /> A4g, C6a, and C6b prior to City approval for development. The other sites approved by
<br /> this order (C3b, C7, D2a, D2b, E3, F1, F2, G1, and 12b) have accepted delineations.
<br /> 3. Wetland alteration for all other sites designated for development (A4a, C1, C6c,
<br /> C6d, C6f, H2, H3, 11, and I2a) are approved by this order according to ORS 196.682
<br /> when approved by the city in accordance with the federal Alternative Permitting
<br /> Procedure.
<br /> 4. The City shall administer the Plan subject to the following conditions.
<br /> 5. The City shall notify the Division of each proposed fill and mitigation project
<br /> subject to 3. above. The Division shall provide written comment and verification of
<br /> compliance with the Plan within two weeks of receipt of City notice. If the Division fails to
<br /> respond within two weeks, the fill and mitigation shall be deemed to comply with the Plan
<br /> and this Order.
<br /> 6. Fill or removal proposed in wetland sites not designated for development and for
<br /> projects where a permit application is pending, the route for the West 11th Parkway and
<br /> Beltline widening projects, shall require individual permit applications from the Division
<br /> according to the provisions of ORS 196.800 to 196.990.
<br /> 7. Wetlands mapped in the WCPI but not designated by the adopted Plan must be
<br /> included in the Plan by amending the Plan pursuant to ORS 196.684 by July 31, 1997.
<br /> 8. This order applies only to those fills or removals approved by the City of Eugene
<br /> under the provisions of the Plan.
<br /> 9. Modifications or amendments of the Plan must meet the procedures and
<br /> requirements of ORS 196.684(1), (2), (3), (4), and (5).
<br /> 10. This approval shall expire on July 31, 1999, unless the director reviews the Plan
<br /> and renews the approval according to ORS 196.684(6) and (7).
<br /> 11. The City shall notify the Division of any Plan changes necessary to meet Total
<br /> Maximum Daily Loads (TMDL) if and when established by DEQ for the Amazon and A -3
<br /> Channels.
<br /> 12. The city shall require all mitigation actions approved under the Plan to be
<br /> completed consistent with policies adopted by the City. The Mitigation Manual will
<br /> provide guidance for implementation of mitigation actions.
<br /> 13. The City shall submit to the Division by December 31 of each year an annual
<br /> report on the status of all authorized fill activities, mitigation actions required and
<br /> completed, mitigation monitoring required and copies of monitoring reports. The annual
<br /> report shall include an analysis of wetland losses by type and area. The report shall
<br /> include information on wetland restoration, enhancement and creation completed by type
<br /> and area and land acquired by location.
