14. The City shall comply with the requirements of DEQ's Section 401 certification. <br /> 15. The City shall notify the State Historic Preservation Officer (SHPO) of each <br /> permit application and condition individual ground alteration projects so as to protect <br /> and /or recover cultural resource materials as required by the SHPO. If cultural materials <br /> are found during ground - disturbing activities, the City shall immediately contact the <br /> SHPO and obtain recommendations for recovery or protection of any cultural resources. <br /> 16. The City shall notify the Oregon Dept. of Agriculture and Oregon Dept. of Fish <br /> and Wildlife of each permit application conceming the potential affects of proposed <br /> projects on listed or candidate threatened or endangered species. If listed species have <br /> been identified or are found on the subject site, the City shall immediately contact the <br /> appropriate agency and obtain recommendations for protection of any listed species. <br /> The protection measures will be adopted as a condition of any permit issued by the city <br /> for wetland development activities. <br /> 17. All construction in the Plan area, including placement of fill, wetland creation, <br /> and enhancement, shall be conducted to: <br /> a. ensure all fill material shall be composed of clean, nonpolluting material. <br /> b. minimize turbidity increases in the water that tend to degrade water quality and <br /> damage aquatic life; and <br /> c. prevent any petroleum products, chemicals, or other deleterious materials from <br /> entering the water. <br /> 18. Site development within the Plan area shall prevent offsite erosion by: <br /> a. seeding, sodding, revegetating using native species, or implementation of other <br /> equivalent type of protection against subsequent erosion; and <br /> b. limiting vegetation clearing to that necessary for project construction. <br /> 19. Upon a finding by the Director, after a public hearing, that the City is not <br /> enforcing the provisions of the Plans and this order, and that such lack of enforcement <br /> has resulted or will result in adverse impacts to wetlands in the Plan area, the director <br /> shall modify, suspend or revoke approval of the wetland conservation plan. <br /> Issued this _ day of , 1994_ <br /> Gary Gustafson, Director <br /> Division of State Lands <br /> kenb:696 <br /> Page 12 - PROPOSED ORDER AND CONDITIONS - City of Eugene <br />
