The stormwater permit is issued by default if not formally issued <br /> ' by the City within 30 days of receipt of a complete stormwater permit application. <br /> Default applies to all development requests where only a building permit is needed - <br /> no other land use actions are necessary. <br /> • Subdivisions & PUDs. Subsequent to tentative plat approval, the permit is issued <br /> by, default if not formally issued by the City within 30 days of receipt of a complete <br /> application. <br /> • Site Plan Review. Subsequent to site plan review approval, the permit is issued by' <br /> default if not formally issued by the City within 30 days of receipt of a complete <br /> stormwater permit application. <br /> • Provide a means to allow extension of the 30 day default period if both parties (City <br /> and applicant) agree. <br /> Because of the iterative nature of the plan's submittal and review process, the 30 day limitation <br /> applies only to days where the City has accepted the application and is in the plans review <br /> process. If and when plans are returned to the applicant for clarification or additional <br /> information, the time restriction on the City is suspended until the plans are adjusted and <br /> returned to the City. <br /> 2.2 Guidance Manual. Is there a need to have a City of Eugene construction site <br /> management guidance manual? <br /> Recommendation: <br /> • Provide a guidance manual based on the best existing manuals from other <br /> jurisdictions and format in as user friendly style as possible. <br /> 2.3 Training and Education. See sections 1.0 -1.21 and 2.2 of this memorandum - <br /> specifically checklists, model plans, and guidance manual. <br /> 2.4 Inspections. See section 1.0 -1.21. <br /> 2.5 Enforcement. What is the appropriate time period for corrective action and what fine <br /> amount is appropriate as a penalty? <br /> Recommendation: - -- <br /> • Impose the maximum fine amount allowed under City code ($500 per day - Section <br /> 2.018 para 5) and provide for a fee reduction down to $100 per day based on the <br /> violator's performance to the penalty (timeliness, willingness, attitude), magnitude <br /> and severity of the violation, and the history of the violator (repeat offender). <br /> 3 <br />
