Planned unit development provisions shall only be used <br /> when: <br /> (a) They are required by an adopted refinement plan or special <br /> area study; <br /> (b) The proposed development cannot be accomplished using other <br /> available zoning or land division provisions; <br /> -C(c) The property is zoned PD sub - district; or <br /> (d) After a public hearing, the hearings official requires that <br /> uses approved prior to March 15, 1968, in accordance with the Permissive <br /> Use Permit procedure then in existence, be developed under these planned <br /> unit development regulations. <br /> (Section 9.509 added by Ordinance No. 17721, enacted July 26, 1976, amended by <br /> Ordinance No. 18055, enacted September 26, 1977, and Ordinance No. 19197, enacted <br /> November 16, 1983, effective January 1, 1984.) <br /> 9.510 General Provision. <br /> (1) Ownershio. The area included in a proposed planned unit development <br /> must be in a single ownership or under the development control of a joint application <br /> of owners or option holders. Individual portions of a planned unit development may <br /> be transferred to additional parties after tentative plan approval provided the <br /> planning director determines: <br /> (a) Final pl an approval based on the approved tentative plan w i l l <br /> not be compromised, and <br /> (b) Documents necessary to assure permanent maintenance of <br /> ' buildings, common use facilities, landscaping, open space and outdoor <br /> living areas at no expense to the city have been executed and recorded. <br /> (2) Prgcessina steps. Prior to issuance of a building permit, planned <br /> unit development applications must be approved at each of the following two steps: <br /> (a Step one • tentative plans.
