IN <br /> MEMORANDUM <br /> May 10, 1993 <br /> TO: Bob Hammitt <br /> From: Jan Stazewski <br /> Subject: Martin Street Citizens Concerns On Logging in Their Neighborhood <br /> In the last week of April the Urban Forester received a call from Ann Leong of <br /> Martin Street. Ms. Leong said that 46 acres of property near her house is for <br /> sale and heard that the timber may be sold separately from the land. She <br /> asked what protection is afforded the trees on the site, and is the PUD <br /> process and provisions of the South Hills Study to be followed before any <br /> trees are removed. She went on to say that the area was zoned PUD, however, <br /> there are no approved PUD plans for the site. The Urban Forester explained <br /> that the owner could either remove trees, under City's Tree Preservation Code <br /> 6.300 - 6.330 or under the provisions of an approved PUD plan. The Urban <br /> Forester went on to say that the PUD process is not required to obtain a <br /> permit to remove trees nor is the South Hills Study applicable until a <br /> development plan is submitted. He stated that along with the other sections <br /> of the Code, sections {6.320(b,d))' would provide a reasonable level of <br /> protection for these trees. <br /> Ms. Leong said that she felt that there was a serious "gap" in the City's <br /> ability to protect trees. She felt that the City should require the PUD <br /> approval process before allowing any removals. She went on to say her <br /> neighbors are afraid that one day, without warning, a logging company would <br /> cut down all the trees as was done a few years ago (e.g., Simpson /Polansky <br /> logging operation within the urban growth boundary). <br /> After discussions with her neighbors, Ms. Leong contacted Councilor Member <br /> Keller for help in protecting their neighborhood. Their understanding of Ms. <br /> Kellor's response was to ask the Urban Forester and Jan Childs (by name) to <br /> attend a neighborhood meeting to help them draft language for Council to adopt <br /> which would require the PUD approval process before removing trees. <br /> Before responding to the neighborhood's request the Urban Forester checked <br /> with the Planning Department. Jan Childs assigned the neighborhood's request <br /> on to Jerry Jacobson. Mr. Jacobson said that he did not plan to attend and <br /> 1 1 6.320 Criteria. In determining whether a proposed felling is <br /> consistent with sections 6.305 to 6.330, the department of parks and <br /> recreation and the tree appeal board, as the case may be, shall base their <br /> decision on one or more of the following: <br /> (b) The topography of the land and the effect of felling on erosion, soil <br /> retention, stability of earth, flow and character of surface waters and <br /> streams, protection of nearby trees and windbreaks. <br /> (d) The effect the trees' removal has on the environmental quality of the <br /> area. <br />
