Date: 07/13/93 <br /> - From: John Weber CEWBJJW - RIS1 <br /> - To: Bob Hammitt CEWMJRH - RIS1 <br /> Johnny Medlin CEWMJRM - RIS1 <br /> Jerry Jacobson CEPLGPJ - EUG001 <br /> Jan Staszewski CEWMJXS - RIS1 <br /> Subject: Tree removal at The Orchards Low Income Housing project <br /> Hopefully I have defused the tree removal as an issue at the above project. <br /> I talked with KVAL and Milo Dudden (LUBA appellant) and they both seemed <br /> satisified with the information I gave them on the trees being removed. In <br /> short: <br /> - The site was the subject of a conditional use review back in Jan. of this <br /> year. (CUP 92 -12) <br /> - Jan S. was involved in the review and did make a site visit and approved of <br /> the proposed tree removal as part of the CUP review process. Jan, if fact, <br /> asked the project landscape architect to remove additional trees due to <br /> poor condition and form. <br /> - The project was approved by the Hearing Official on 4/5/93. That decision <br /> was appealed to the Planning Commission, and the PC upheld the H.O's <br /> decision. An appeal was subsequently made to LUBA, which is still pending. <br /> - Since the project has been "approved at the local level" the developer is <br /> able to proceed with site development and obtain any building permits. Any <br /> work done at this time is at their own risk if LUBA reverses the local <br /> decision. <br /> - I talked with Jerry Jacobson in Planning and he told me the H.O.'s findings <br /> allowed for removal of all but a few of the trees on the site. Most of the <br /> trees were filberts, which are not considered native, and were noted to be <br /> in poor condition. Jerry stated that the trees were not an "issue" during <br /> the review or public hearing on this project. <br /> - From what I could determine from Jan's notes and in talking with Jerry J. and <br /> Johnny M., a tree cutting permit was not obtained, however, in essence an <br /> "approval" was given by Jan thru his review and imput on the conditional use <br /> permit. Technically, it was not a tree removal permit, but since we have not <br /> been charging a fee yet, and since the developer is another public agency <br /> (Lane County Housing Authority), Johnny felt that Jan's review of the CUP <br /> would /could be construed as tree removal permission. <br /> I hope I have covered all the details on this issue. If I have missed some- <br /> thing please let me know. <br /> - jw <br />
