For instance, if the Respondent had realized that the <br /> City was alleging that she had violated Eugene Code 6.305(1) because tax lot 1000 was <br /> 190 square feet in excess of the maximum size she would have had an opportunity to either <br /> have the property surveyed or to recompute the area of the parcel from its metes and <br /> bounds description. <br /> Conclusions of Law: <br /> Based on the evidence in the record, the findings of fact, and the analysis set forth above, the <br /> Administrative Civil Penalty issued to Respondent Tamara Breach is dismissed.
