Mr. Ansola has applied for, but not obtained <br /> the PEPI and erosion control approvals. He has not applied for a Cut and Fill Permit, Site <br /> Development, or a Tree Removal Permit. The City has not authorized any clearing, grading or tree <br /> removal activity on the site. <br /> • Tax Lot "1" (tax lot number to be verified): <br /> Clearing and grading have occurred in the vicinity of the ODOT right -of -way and Moon Mountain <br /> Road/Glenwood Boulevard. It appears that most of the trees removed may have been located within <br /> the future right -of -way. If the right -of -way had been approved, removal of these trees would be <br /> exempt from a Tree Removal Permit. However, the future right -of -way has not been staked, and it is <br /> unclear at this point if it is approved. Approximately 3 -5 trees removed may be located outside of any <br /> future right -of -way. Under the Eugene tree regulations, up to 5 trees may be removed on this site, as it <br /> is over 20,000 s.f. in area. Therefore, up to 5 trees removed outside of the right -of -way may also be <br /> exempt from the tree code. Mr. Ansola indicated he has a permit from ODOT to realign access road, <br /> and that he thought his work was therefore in compliance with City requirements. <br /> • Tax Lot "2" (tax lot number to be verified): <br /> Clearing and grading have occurred in several areas on the 2' parcel located below the right -of -way <br /> work. As this site is greater than 20,000 s.f. in area, up to 5 trees may be removed without a Tree <br /> Removal Permit. It appears that approximately 25 -30 trees that would be subject to protection under <br /> the tree code have been removed. <br />
