User's responsibility for unsafe conditions: In the event the using party dis- <br /> covers a previously unknown but serious safety hazard existing on the owning <br /> party's property, and chooses to use the facilities before the owning party has <br /> been notified, the using agency shall indemnify, defend and hold harmless the <br /> owning agency from any claims for bodily injury, property damage or personal <br /> injury (including expenses) arising from the hazardous condition if such injury <br /> or damage occurs while the property is under the control of the using party. <br /> XIII. Government Rules and Regulations: <br /> All users of Eugene School District and City property shall comply with all federal, <br /> state, and municipal equal opportunity laws and regulations prohibiting discrimi- <br /> nation. <br /> XIV.
