Fund Raising Events: <br /> If a fund raising event is held, the organization's policies in whose facility the <br /> activity is being held will apply. <br /> IX. Use of Equipment: <br /> A. The owning party will let the using party make use of such equipment as balls <br /> (rubber only), kick boards, lane markers, volleyball nets and tumbling mats on <br /> the premises after the owning party has given a qualified person proper in- <br /> struction in their use. <br /> B. In the case of documented damage to the owning party's facilities, equipment or <br /> supplies, or if equipment or supplies are lost or stolen while in use by the <br /> using party, the using party will replace or pay for the damage or loss. A plan <br /> will be worked out with the building principal /supervisor to replace equipment <br /> that is used excessively. <br /> C. The owning party will make all necessary repairs to its facilities. However, <br /> the using party may make emergency repairs to the owning party's facilities by <br /> mutual agreement. <br /> X. Safety, Conduct, and Facility Use Rules and Regulations: <br /> The using party is responsible for knowing and enforcing all safety, conduct and <br /> facility use rules and regulations of the facility being used. <br /> XI. Security: <br /> rt <br /> Because of security systems located in the buildings of both parties, staff members <br /> with security control numbers should be assigned as supervisors when possible. <br /> XII. Indemnification: <br /> A. Damage to owner's property: Both parties agree that the using party shall be <br /> responsible for any damage caused to the owner's property and resulting from the <br /> activities of the using party, its members, officers, agents, and invitees. <br /> B. Damage to third parties: Both parties agree that the using party shall indem- <br /> nify, defend, and hold harmless the owning party from any liability for bodily <br /> injury, property damage, or personal injury (including expenses), arising out of £, <br /> and resulting from the activities of the using party, its members, officers, <br /> agents and invitees. <br /> C. Owner's responsibility for unsafe conditions: Both parties agree that the <br /> owning party is responsible for any liability resulting from the owner's failure <br /> to maintain the property or warn of a known hazard. If the owning party becomes <br /> aware of an unsafe condition that cannot be corrected within a reasonable period <br /> of time, or if the hazard is serious, the owning party may suspend the use of <br /> the facility until such time as the condition is corrected. If the correction <br /> cannot be made within a reasonable period of time and the using party is so <br /> -4- <br />
