ADMINISTRATIVE ORDER N0.58-02-17-F of the City Manager pro tem of the City of Eugene AMENDMENT TO THE .WASTEWATER USER FEE SCHEDULE BY INCREASING THE MWMC SEPTAGE HAULER FEE AND REPEAL OF ADMINISTRATIVE ORDER N0.58-01-10-F. The City Manager pro tem of the City of Eugene finds as follows: A. Section 6.411 (formerly Section 7.020) of the Eugene, Code, 1971, authorizes the City Manager to determine and set fees and, charges to be imposed by the City for wastewater service, regional wastewater service, and stormwater service. B. In accordance with the procedures set forth therein, on May 30, 2002, I issued Administrative Order No. 58-02-17, and notified the Mayor and City Councilors that I intended to increase the MWMC sanitary. sewer fee. for septage haulers, as set forth in the Notice attached thereto, which had been adopted by Administrative Order No. 58-01-10-F on June 21, 2001. C. Notice was also provided to the news media, any person who had requested notice, and to interested governmental agencies (including the United States Environmental Protection Agency, the Department of Environmental Quality, MWMC, and the Eugene Water & Electric Board). In addition, the Notice was posted at two locations at City Hall on June 3, 2002, and published on two separate occasions in the Register-Guard, a newspaper of general circulation within the City, to wit: June 3 and 4, 2002. The Notice was made available for inspection by interested persons at the offices of the Public Works Department, 858 Pearl Street, Eugene, Oregon, 97401, during normal business hours (8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). D. The Notice provided that written comments would be received for a period of 10 days from the first date of publication and posting, or at the public hearing to be held in the Public Works Department, 858 Pearl Street, Eugene, Oregon, 97401, on June 17, 2002, between noon and 2:00 p.m.. No one appeared for the public hearing and no written comments were received within the time or in the manner required by the Notice. E. Pursuant to subsection (1) of Section 6.411 of the Eugene Code, 1971, I have conducted an investigation of the revenue needs of the City in providing these services and have reviewed the recommendation of the Metropolitan Wastewater Management Commission (MWMC). F.
