ADMINISTRATIVE ORDER NO.58-98-11-F <br />of the <br />City Manager Pro Tem of the City of Eugene <br />ESTABLISHING AMENDED MWMC SEPTAGE USER FEES <br />AND REPEALING ADMINISTRATIVE ORDER N0.58-96-10-F <br />The City Manager Pro Tem of the City of Eugene finds as follows: <br />A. Section 6.411 (formerly Section 7.020) of the Eugene, Code, 1971 authorizes the City <br />Manager to determine and set fees and charges to be imposed by the City for wastewater service, <br />regional wastewater service, and stormwater service. <br />B. In accordance with the procedures set forth therein, on May 29, 1998 I issued <br />Administrative Order No. 58-98-11 proposing an increase in MWMC septage user fees as set forth <br />in the Notice attached thereto, and the revision of Administrative Order No. 58-96-10-F. <br />C. Copies of the Notice were provided to the Mayor and City. Councilors, the news <br />media, any person who had requested notice, to interested governmental agencies (including the <br />United States Environmental Protection Agency, the Department of Environmental Quality, <br />'~ MWMC, and the Eugene Water & Electric Board), and posted at two locations at City Hall on June <br />3, 1998. The Notice was also published on June 3 and June 7, 1998 in the Register Guard, a <br />newspaper of general circulation within the City, and made available for interested persons at the <br />offices of the Public Works Department, 858 Pearl Street, Eugene, Oregon 97401, during normal <br />business hours (8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). <br />D. The Notice provided that written comments thereon could be submitted for a period <br />of 15 days from the first date of publication and posting, or at a public hearing to be held on June <br />17, 1998. No written comment was received within the time or in the manrier required by the notice, <br />and no testimony was submitted at the public hearing. <br />E. Pursuant to Subsection 6.411(1) of the Eugene Code, 1971, I have conducted an <br />investigation of the revenue needs of the City in providing these services and reviewed the <br />recommendation of the Metropolitan Wastewater Management Commission (MWMC). <br />F. Based on that investigation and recommendation, and the findings set forth herein, <br />I find the proposed septage user fees are in compliance with the Council's directive that the costs of <br />providing such services be recovered from the beneficiaries of the services, and other applicable <br />policies and directives of the Council; are consistent with applicable federal and state regulations and <br />the recommendations of MWMC; are comparable to the amounts charged by the City of Springfield <br />and other such service providers; and are based on the adopted budget of MWMC. <br />Administrative Order - 1 <br />
