ADMINISTRATIVE ORDER N0.58-05-04-F <br /> of the <br /> City Manager of the City of Eugene <br /> AMENDMENT TO THE WASTEWATER USER FEE <br /> SCHEDULE AND REPEAL OF ADMINISTRATIVE ORDER <br /> NO. 58-04-12-F <br /> i <br /> The City Manager of the City of Eugene finds as follows: <br /> A. Section 6.411 of the Eugene, Code, 1971, authorizes the City Manager to <br /> determine and set fees and charges to be imposed by the City for wastewater service, <br /> regional wastewater service, and stormwater service. <br /> B. In accordance with the procedures set forth therein, on May 6, 2005, I issued <br /> ~?dministrative Order No. 58-05-04, and notified the Mayor and City Councilors that <br /> untended to increase the Wastewater User Fee Schedule established by Administrative <br /> Order No. 58-04-12-F on June 16, 2004, as set forth in the Notice attached thereto, <br /> effective for all bills issued on or after July 1, 2005. <br /> C. Notice was also provided to the news media, any person who had requested <br /> notice, and to interested governmental agencies (including the United States <br /> Environmental Protection Agency, the Department of Environmental Quality, MWMC, and <br /> the Eugene Water & Electric Board). In addition, the Notice was posted at two locations at <br /> pity Hall on May 13, 2005, and published on two separate occasions in the Register- <br /> ; Guard, a newspaper of general circulation within the City, on May 13 and 14, 2005. The <br /> Notice was made available for inspection by interested persons at the offices of the Public <br /> ~ Works Department, 858 Pearl Street, Eugene, Oregon, 97401, during normal business <br /> hours (8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). <br /> i <br /> D. ' The Notice provided that written comments would be received for a period of <br /> ten days from the first date of publication and posting, and that comments would also be <br /> received at the public hearing to be held in the McNutt Room of Eugene City Hall, 777 <br /> Pearl Street, Eugene, Oregon 97401 on May 26, 2005, between 5:30 PM and 6:30 PM. <br /> <br /> ~ iVo comments were received at the public hearing or within the time or in the manner <br /> ;provided in the Notice. <br /> E. Pursuant to subsection (1) of Section 6.411 of the Eugene Code, 1971, <br /> have conducted an mvestigation of the revenue needs of the City in providing these <br /> services and have reviewed the recommendation of the Metropolitan Wastewater <br /> Management Commission (MWMC). <br /> F.
